Terms and Conditions of Business

By agreeing to the following Terms and Conditions set by Alice Ford (ABN 37152270692) (the artist), you (the client), are legally obliged to cooperate with all clauses outlined. The artist may ask to film/photograph and publish the works online or to social media platforms. If you (the client) are not comfortable with this please let the artist know prior to creation of the work to ensure privacy of work commissioned.

1. Quotes and Estimates

1.1. All quotes/estimates are valid for 30 days from the date of submission.

1.2. Quotes/estimates are based on the information provided by the Client, including but not limited to detail on quantities, structure, scope and functionality. Any quote/estimate may therefore be subject to change should the client’s requirements change at any time.

1.3. Any estimates given by the artist in relation to the time of completion or manner of services (whether completion of the whole or a part of those services) shall be estimates only and time shall not be of the essence.

1.4. Quotes for mural works will be estimated from a square meter rate (see clause 2.1) unless an alternative agreement has been made (this is also inclusive of material cost.)

1.5. Quotes for canvas/graphic works will be estimated on independent factors. (see clause 2.2, 2.3, 2.4.)

1.6. Material fees will be included in the initial quote unless quoted for separately or additional/unexpected materials are required.

1.7. A design fee will be included in the initial quote.

2. Pricing

2.1. Square Meter (sqm) Rate.

Less than 8sqm: $250/sqm

Greater than 8sqm but less than 20sqm: $200/sqm

Greater than 20sqm: $150/sqm

2.2. Canvas and paper works will be priced in accordance to the ordered size and medium used.

2.3. Graphic design and photoshop poster works will be charged at a rate chosen by the artist (either hourly or by amount of items required)

2.4. The client is allowed two minor changes and one major change to the first design presented by the artist. If more is required, an additional charge or hourly rate of $40/hr will be added to the initial set price or quote set by the artist in the final invoice.

3. Design

3.1. The designs from the artist will remain the artists own intellectual property.

3.2. The final design is a design only and is only a reference for an interpretation on a larger scale. The artist will not be accountable for imperfections in the translation from design to wall.

3.3. The artist reserves the right to sell the designs as original paintings unless otherwise agreed.

4. Maintenance

4.1. The artist is under no obligation to maintain the work after completing a mural or product. Measures in material and wall/frame preparation will be undertaken to ensure longevity.

4.2. Anti-Graffiti proofing is an additional fee and it is advised that the client looks into this through an independent contractor if it is a concern.

5. Payment

5.1 Payment must be made in full no later than 30 days from the submission of the invoice.

5.2 If the client cancels the outlined work after designs have already been completed, the artist reserves the right to charge a design fee of $40/hr based on time spent on designs to the point of cancellation.

5.3.b) If the client cancels the outlined work, or changes the start date within one week of the start date, a $250 cancellation/ disruption fee must be made to the artist for mural works. This cancellation fee does not imply to small scale commissions.

5.4. If the client fails to pay the artist within the allocated time, a late fee of $50/week will be implied
